About these terms
These terms apply to your use of sendlab.ai and SendLab services. SendLab is an offering of Enform Pty Ltd (ABN 19 657 432 712) (“SendLab”, “we”, “us”). By using the website or services you agree to them. If you use SendLab on behalf of an organisation, you confirm you’re authorised to accept these terms for it.
If you have a signed customer agreement, order form or master services agreement with us, that agreement governs your use of the platform and takes priority over these terms where they conflict.
Using the website
You may use this website for lawful purposes. You must not:
- interfere with or disrupt the website, or attempt to gain unauthorised access to it;
- scrape, copy or reuse content except as allowed by law or with our permission; or
- use the website to send unlawful, misleading or harmful material.
Using SendLab services
Access to the SendLab console and API requires an account and is subject to the applicable plan, pricing and any customer agreement. You’re responsible for keeping credentials and API keys secure and for all activity under your account. Pricing, usage units and payment terms are set out in your plan or order form.
Acceptable use
You’re responsible for the messages you send and must comply with all applicable laws, including anti-spam, telemarketing and privacy laws such as the Spam Act 2003 (Cth). In particular you must:
- have the consent required by law before messaging anyone, and honour opt-outs promptly;
- identify yourself as the sender and not impersonate any person or organisation;
- not send unlawful, fraudulent, deceptive, harassing or malicious content, including phishing; and
- comply with carrier, channel and sender registration requirements for the destinations you message.
We may suspend traffic or accounts that breach these requirements or put our network, carriers or other customers at risk.
Intellectual property
The website, platform, software, documentation and SendLab brand are owned by us or our licensors. You keep ownership of the content and data you provide; you grant us the rights needed to deliver and support the services. Feedback you give us may be used to improve SendLab without obligation to you.
Third-party links
The website may link to third-party sites and services. We’re not responsible for their content or practices.
Consumer law and disclaimers
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other legislation that cannot lawfully be excluded. Subject to that, the website and its content are provided “as is”, and we don’t warrant that they will be uninterrupted, error-free or suitable for any particular purpose. Message delivery depends on carriers and networks outside our control.
Limitation of liability
To the extent permitted by law, we’re not liable for any indirect or consequential loss, or loss of profit, revenue, data or goodwill, arising from your use of the website or services. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to resupplying the services or paying the cost of having them resupplied. Liability under a customer agreement is governed by that agreement.
